Terms of Service

These terms govern your use of SceneFeed (the "Service"), operated by punkrock.social ("we", "us"). By creating an account or using the Service, you agree to these terms and to our Community Guidelines. This agreement is the end-user license agreement (the "EULA") between you and us for the SceneFeed apps and website.

SceneFeed evolves. We add and change features over time — new ways to post, share, message, and connect. These terms and our Community Guidelines apply to every feature of the Service, including ones we launch after the date above, whether or not this document names them specifically.

1. Eligibility

You must be at least 13 years old to use SceneFeed. By creating an account you represent that you meet this requirement. If we learn that an account holder is under 13 we will terminate the account and delete the associated personal information.

If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf.

2. Your account

You are responsible for the activity on your account and for keeping your credentials (email, Apple ID) secure. You agree to provide accurate information when registering and to keep it up to date.

We reserve the right to suspend or terminate accounts that violate these terms, our Community Guidelines, or applicable law.

3. Acceptable use and objectionable content

You agree not to post, upload, send, or share objectionable content or engage in abusive behavior anywhere on the Service — in posts, photos, videos, memories, comments, captions, messages, profiles, or any other feature. Objectionable content includes, but is not limited to:

  • Content you don't have the right to share, including infringing flyers, photographs, video, or audio.
  • Harassment, bullying, threats, hate speech, or impersonation of other users, performers, venues, or scenes.
  • Sexually explicit material, and any content that sexualizes or endangers a minor.
  • Content that promotes violence, illegal activity, self-harm, or the sale of illegal goods or services.
  • Sharing others' private information without consent, spam, scams, or fraudulent schemes.
  • Scraping, mirroring, or bulk-extracting data from the Service, or probing, attacking, or bypassing its security.

We have zero tolerance for objectionable content and abusive users. You can report content and block users from within the app. We review reported content and, where it violates these terms or our Community Guidelines, remove it and take action against the responsible account — typically within 24 hours. Full standards are set out in the Community Guidelines.

4. Your content

You retain ownership of the content you post — including flyers, comments, photos, videos, memories, captions, messages, and any other text, images, video, audio, or materials you submit through current or future features. You grant SceneFeed a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute your content within the Service for the purpose of operating and providing SceneFeed. This licence ends when you delete the content or your account, except where we are required to retain a copy by law.

5. Copyright and DMCA

We respect intellectual property rights. If you believe content on SceneFeed infringes your copyright, see our DMCA Policy for how to file a notice.

We maintain a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers.

6. Account termination

You may delete your account at any time from inside the app, or on the web at scenefeed.app/legal/delete-account. Deletion removes your profile, posts, RSVPs, friendships, and uploaded media, except where we are required to retain limited records for legal, fraud-prevention, or safety reasons (for example, hashed identifiers of users banned for violating age requirements).

We may suspend or terminate your account if you violate these terms, create a risk or possible legal exposure for us, or if our provision of the Service to you is no longer commercially viable.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you have paid us in the past 12 months (if any) or (b) USD $100.

9. Governing law

These terms are governed by the laws of California, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Orange County, California.

10. New and beta features

We regularly release new, experimental, or beta features. They are provided on an "as available" basis, may change or be withdrawn at any time, and are governed by these terms and our Community Guidelines just like the rest of the Service. Where a new feature materially changes how we handle your personal information, we'll also update our Privacy Policy.

11. Apple and other app stores

If you download SceneFeed from the Apple App Store, you also agree to Apple's standard Licensed Application End User License Agreement. Where those terms and ours differ for the Apple-provided app, the following apply: these terms are between you and us, not Apple, and Apple is not responsible for the app or its content; Apple has no obligation to provide support or to address any claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Similar terms apply to other app stores through which you obtain the app.

12. Changes

We may update these terms from time to time. When we make material changes we will bump the version number above and, where appropriate, require you to re-accept before continuing to use SceneFeed.
